First offense misdemeanor DWI... unless there were weird extenuating circumstances, I'm not taking him off the board for it. If it's a late day two or day 3 pick, it'd be a big help filling a hole without blowing a premium selection.
Every time I read DWI and Texas in the same sentence, I think of Dazed and Confused and chuckle a little.
