DEI is not legalized discrimination because discrimination (especially in employment decisions) is illegal. Most DEI programs are actually illegal. That's why companies are shitting their pants after the Supreme Court decision on affirmative action. I can tell you as a lawyer that the Supreme Court decision actually had nothing to do with the employment context. It was relevant to college admissions and was evaluating the equal protection clause. Employment decisions fall under Title VII of the Civil Rights Act.

DEI programs that promote training and casting a wider net to source from different areas/employers are legal. In other words, source a bigger pool and pick the best candidate. The hope is that you organically get a more diverse workforce. Nothing wrong with that.

The problem is that isn't how it is working practice. Leaders are under pressure. You see companies with stated goals of X% of our population have to be BIPOC. Well, when you start to set quotas, that violates the laws. When you tell managers that they will be paid (ie. incentivized to hire minorities), that violates the law. When you flat out say, I need 2 more VPs that are black or hispanic or whatever, then that violates the law. There is more of that going on that people would like to realize.

Companies CANNOT tip the scales in hiring and promoting decisions based on race, sex, gender, etc factors, but they often are. Just like Harvard was in admissions. Companies are now scared because they know whites will now be more emboldened to sue them over Title VII or state law.

So, in practice DEI has become an insidious form of discrimination to the extent companies are doing what I outlined above. That's wrong and it always will be.

My wife’s nephew is black. His dad played college football and really is pushing sports onto the kid who only does it because dad wants him to.

What he really excels at is academics. His teacher said not only is he the smartest kid in her class he’s the smartest kid she’s ever had.

And yet, DEI initiatives are trying to eliminate advanced placement courses because they are discriminatory to POC.

Well, if they do away with them in his district the policy meant to be “fair” will actually do harm by preventing his advancement.

Agreed. He is very smart. A very kind and gentle kid. Just not aggressive for football and actually cries at times when his dad makes him practice (after regular practice) and work out.
